Spotify vs. NMPA: Legal Battle Over Lyrics and Royalties

On May 15, 2024, the National Music Publishers’ Association (NMPA) issued a legal warning to Spotify, alleging that the streaming service hosts unlicensed lyrics, music videos, and podcasts. The NMPA, representing major publishers such as Sony Music Publishing, Warner Chappell, and Universal Music Publishing Group, demanded the removal of this content to avoid copyright liability. In response, Spotify dismissed the claims as a "press stunt" filled with "false and misleading" assertions, suggesting the move is a diversion from the contentious Phonorecords IV settlement of 2022. This settlement allowed bundled services to pay lower mechanical royalties than standalone music subscriptions, a classification Spotify adopted for its Premium tiers, much to the ire of the NMPA. This ongoing dispute underscores the tensions between streaming platforms and music publishers over fair compensation for songwriters. The Recording Academy's Songwriters & Composers Wing has expressed support for the NMPA, emphasizing the importance of fair payment for songwriters.

OpenAI's GPT-4o Demonstrates Advanced AI-to-AI Interaction

Not gonna lie, this one was a bit scary! OpenAI has launched GPT-4o, its latest iteration of the ChatGPT large language model, capable of reasoning across audio, vision, and text in real time. In a recent demonstration, two AI-enabled smartphones interacted to interpret their surroundings and create a song.

The AIs compose and sing a song based on their observations. While the musical performance might not yet rival human creativity, it showcases the rapid advancements in AI's creative capabilities.

Despite these technological leaps, the future role of AI in creative fields remains contentious. As AI tools continue to evolve, the potential impact on human creativity is a growing concern, echoed by artists like will.i.am, who predicts AI might soon produce music that rivals human compositions.

Sony Music Warns Tech Companies Against Unauthorized Use of Music for AI Training

Sony Music Group has issued letters to over 700 tech companies and music streaming services, cautioning them against using its music to train AI systems without explicit permission. Obtained by TechCrunch, the letter claims that some recipients may already have used Sony's content without authorization. Sony emphasizes that while AI holds significant potential, unauthorized usage deprives the company and its artists, including high-profile names like Harry Styles, Beyoncé, Adele, and Celine Dion, of control and fair compensation.

The letter underscores Sony's commitment to protecting its intellectual property, which encompasses audio and audiovisual recordings, cover artwork, metadata, and lyrics. Recipients are asked to disclose details about any Sony songs used for AI training, including how the songs were accessed, the number of copies made, and their current status.

Sony's strong stance highlights the ongoing tension between technological innovation and the protection of creative rights, advocating for a balanced approach that respects the contributions of artists and songwriters.
